Of course it matters.
A profession photo that is copywrited should not be reproduced without permission.
But an artistic interpretation of something iconic is fair game. [I need not remind anyone around here just who is a gay icon.] And if you took that ridicules bag off your head you'd probably see that. Unmask yourself and free those pores, sister, free those pores.

There's a difference, Sueleen. You can attempt, and sometimes succeed, in suing someone for using a photo without permission, but it's a little more difficult if you are a public figure.
You can easily win a lawsuit if you have taken the photo and someone else used it....copywrite laws.
A drawing, caricature or other work of art craeted by hand is not subject to the same laws as long as you hold the copywrite. Someone cannot sue you for drawing a picture of them and displaying it. A caricature, especially, is not an exact image of the person so they cannot prove beyond doubt that it is them being portrayed.
