Forgive me if this has been posted before. Apparently he does not have a license to practice in California nor in his home state of Texas. He is also accused of violating HIPPA Law when he chose to discuss Britney Spears' case with the media.

When I heard him speak, the first thing I thought of was HIPAA. Unless, BS signed a HIPAA disclosure form allowing him to disclose health information to the world, he likely violated federal law.
Um, I think the family asked him to see her AS A FAMILY FRIEND.
And how could there be violations of confidentiality if she never spoke to him, as was reported. This will go nowhere.

HIPAA requires written authorization to disclose personal health information regardless of how it is obtained.
If he acted as a medical professional he will be liable. However if he can prove that he was a family friend visiting Britney and was not evaluating her in any way he may very well get away with this. He can just say he is a crappy friend with a big mouth. It will all depend on how he presented himself to the hospital staff and what her family says.
Dr. Phil is just another wack "Oprah clone" media ho lookin' for ratings, plain and simple, like the rest of them. Wait till "The Dr. Oz" show. What --"You mean I can make a zillion dollars instead of actually practicing my profession, if Oprah clones me? I'm in."

So even if he is not licensed and says he just went to the hospital as a "friend of the family", and Brit didn't talk to him he can still be brought up on charges?
And what did he say about her condition?
Ah, Dr. Phil.
Two moments stand out: when he advised poor befuddled parents to take a doll away from their son because it's just not natural. This is from a therapist? (I wish someone had taken away his Mr. Microphone when Phil was a lad.)
And his appearance on Letterman when he was pushing his bogus weight-loss book. As Phil nervously pulled his 46 long jacket around his 42 inch waist, trim Dave looked him up and down, and said, "so YOU've written a diet book, eh?"

Sorry if I sound uncharitable, but anything that finally puts a stop to that pompous faux-psychologist and his fortune-cookie platitudes is fine with me.

what's even more disturbing is why he lost his license in Texas. This is man one big joke. You would think Winfrey would distance herself considering what happened at the school she opened.
