The theatre has around 800-1000 seats and is on 42nd Street.
Is there any reason, aside from the type of productions that play there that the New Victory Theatre can't be a Broadway house?

I know its family friendly entertainment in short engagements, but should the owners/operators want to open a guaranteed moneymaker, could they rent it out to a production and be considered on Broadway?

Yes the New victory can and has been a broadway theatre. I believe there was a while back when the theatre was shut down and old and the new victory company referbished it and started using it as a childrens theatre. But, in short it did used to house broadway shows.

I know that. My question was more along the lines of 1. why isnt it a Broadway house now? and 2. What has to be done to make it a Broadway house again since it meets the requirements?

Its not a broadway house now because its not playin a full comercial sp? of a show. It only houses small short run childrens shows. Keep in mind that what makes a theatre a broadway theatre is not only the size of the house. that is a majortiy of it. But the theatre has to house a commercial run of a particular show. There are other theatres in NYC that are big enough to be considered a broadway show. But, they don't have commercial runs of show to be one. A perfect example is Radio city music hall. It has enough seates but won't ever be home to a long commercial run of a show.

So, if the new victory theatre ( the name of the company that owns the theatre and is incharge of putting the childrens shows there) ever folds and a producer rents it out and puts a commercial run there then it would be a regular broadway house again.
