If this were legal, nothing would stop someone from uploading thousands of songs, selling the iPod at a premium price, and keeping all of their CDs. They could then upload those CDs to ANOTHER iPod and sell that. Since they are making more money on loaded iPods than they would on empty ones, the issue is more comparable to selling COPYS of your CDs and keeping the originals. Selling copies for a profit has never been within the legal rights of a CD owner...

If I have a CD and make copies of it and sell each copy for $5, I'm making pure profit, and retaining my CD. This is clearly not legal. Same principle with the 'Pods. Loaded iPods (it appears) routinely sell for more than the average iPod sells for. In other words, people are willing to pay a bit more for an iPod full of music they now don't need to buy. It is the fact that the iPods are being advertised as "loaded". The sellers realize that it is the music and materials on the iPod are the draw of the sale.
My confusion comes from the fact that eBay seems to have already made public statements about their stance on the issue, so this is really already an established matter of company policy, isn't it?
