I don't think that spouses can be compelled to testify, but they can do it if they don't object. If she's being called to testify against him, I wouldn't pass the chance, if he were unlucky enough to be my spouse.

Wow oh wow. I'm part of the Customer Care org here at work. My boss rules over several call centers, filled with Unioned employees. I see a lot of suspensions, terminations and whatnot come through. A good portion of the employees are very hard workers, and the rest will look for any excuse to not come in, goof off, etc. Just got notice that they are getting ready to investigate this one person, cause time off was taken due to "father's death". And, guess what? The father is still kicking.
Why on God's green earth would you even use something like that as an excuse/reason? I would never even use car problems as a reason for fear I would jinx myself!! So many people out of work, that would have no problem abiding by the rules, and you have people like this out there with a decent job/pay/benefits. My mind boggles.

Is he being prosecuted in Federal or State court? If he in Federal Court, there are different privilege/discovery rules.
And usually, the privilege only applies to communications solely between spouses (and there are some exceptions, though Florida generally does not have the crime-fraud exception). I think I recall this all took place in Florida.
So, if others were present and it was not a communication solely between the spouses, the privilege should not attach.
But, that is just a shot in the dark.
