My friend asked me to help start his non-profit theater company. I know the process and generally what is needed, but I have a question.
He lives in New Jersey, but the majority of his income would likely come from New York. So should we incorporate in New Jersey or New York? I'm not familiar with non-profit law in New Jersey, so I don't know which would be more favorable to the business.
Additionally, if we do incorporate in New Jersey, would we pay taxes on any New York income if we do not apply (and pay) for tax exemption in New York as well? Is it worth it?

A good place to ask is at New Jersey Volunteer Lawyers for the Arts. Since you guys have a little startup NPO, they'll get you legal advice for free. If they can't find someone who knows NY NPO law (doubtful, but possible), NYC has its own Volunteer Lawyers for the Arts organization. Just Google them.
