Like I said, perhaps you should read the entire Constitution - otherwise, folks might to the same conclusion that I have about you. Just this last time, I will give you a hand and show you where IN THE CONSTITUTION the Supreme Court's powers come from, including the powers under Law and Equity arising under the Constitution". The SCOTUS is specifically designated by the Constitution as the Judicial Authority over it.


Article III - The Judicial Branch Note

Section 1 - Judicial powers

The judicial Power of the United States, shall be vested in one supreme Court, and in such inferior Courts as the Congress may from time to time ordain and establish. The Judges, both of the supreme and inferior Courts, shall hold their Offices during good Behavior, and shall, at stated Times, receive for their Services a Compensation which shall not be diminished during their Continuance in Office.

Section 2 - Trial by Jury, Original Jurisdiction, Jury Trials

(The judicial Power shall extend to all Cases, in Law and Equity, arising under this Constitution, the Laws of the United States, and Treaties made, or which shall be made, under their Authority; to all Cases affecting Ambassadors, other public Ministers and Consuls; to all Cases of admiralty and maritime Jurisdiction; to Controversies to which the United States shall be a Party; to Controversies between two or more States; between a State and Citizens of another State; between Citizens of different States; between Citizens of the same State claiming Lands under Grants of different States, and between a State, or the Citizens thereof, and foreign States, Citizens or Subjects.) (This section in parentheses is modified by the 11th Amendment.)

In all Cases affecting Ambassadors, other public Ministers and Consuls, and those in which a State shall be Party, the supreme Court shall have original Jurisdiction. In all the other Cases before mentioned, the supreme Court shall have appellate Jurisdiction, both as to Law and Fact, with such Exceptions, and under such Regulations as the Congress shall make.

The Trial of all Crimes, except in Cases of Impeachment, shall be by Jury; and such Trial shall be held in the State where the said Crimes shall have been committed; but when not committed within any State, the Trial shall be at such Place or Places as the Congress may by Law have directed.

Section 3 - Treason Note

Treason against the United States, shall consist only in levying War against them, or in adhering to their Enemies, giving them Aid and Comfort. No Person shall be convicted of Treason unless on the Testimony of two Witnesses to the same overt Act, or on Confession in open Court.

The Congress shall have power to declare the Punishment of Treason, but no Attainder of Treason shall work Corruption of Blood, or Forfeiture except during the Life of the Person attainted."

I know where the powers of the SCOTUS come from! I want to know where they get the power to INTERPRET the Constitution. I did not see that power mentioned in the portion you selected.

I never said that taxes were only for the military. The federal government has the power to levy taxes on the American citizenry in order to fund those powers which are, Constitutionally, powers of the federal government, of which a military and national defense are included. There are 18 enumerated powers of the federal government. Taxes are raised to fund the federal government so it can carry out those enumerated powers. Funding Planned Parenthood or other similar organizations is NOT an enumerated power of the federal government.

Hmmm, and THAT says that the SCOTUS can INTERPRET the Constitution??? I don't even see the work INTERPRET or any synonym thereof in the quote you referenced!!

Not only do I have "my views", I am able to support them and find Constitutional merit for them. Something which you are completely unable to do, as this thread proves.

Yup that's what is says. Since all rulings of any court are simply interpretations of the Laws...or in the case of the Supreme Court their interpretation of the Laws as they are applied to the Constitution.

It's sort of silly to be this willfully ignorant. Don't you think if the Supreme Court didn't have the authority to interpret the laws as they apply to the
Constitution...someone...somewhere over the past 200 hundred odd years. Would have challenged that authority? And if it was found that they didn't have the authority don't you think and amendment to the Constitution would have been written to ensure that?

You are confusing interpreting "laws" for their Constitutionality, and interpreting the actual Constitution. They are two very different things.

Namo, thanks for bringing the conversation back on track. As someone who has donated routinely to Komen in the past, I know I will have problems doing so again. At this point, I have a negative visceral reaction to many things that has been disclosed about Komen - it goes far beyond the PP fiasco. It seems that Komen has become breast cancer's version of the Military Industrial Complex.

I will look for other worthwhile charities to donate to for breast cancer research. Personally (and I do mean personally, I respect everyone's right to donate as their conscience dictates), and I interested in an organization that pursues the scientific cure to the disease as permitted to the extent of the law, including embryonic stem cell research.

If anyone has a listing of charities they would like to share, it would be greatly appreciated.

The Komen disaster is very sad. I try whenever possible to donate directly, because it seems the larger an organization gets, the more likely it is to lose its way.

No...I know that their rulings and their interpretation of the Constitution have been challenged and will continue to be challenged. That is the nature of Law...and because the Supreme Court is made up of ever changing members whose ideology will influence its decisions.

PP provides the screenings, and a referral for the mammograms. As other women know, generally a physical screenings is done to determine whether there are any irregularities or lumps. If an irregularity is found, then you are sent to get a mammogram and/or a biopsy. If there is cause for concern, it provides a referral for the mammogram/biopsy, and in many instances, helps pay for it.

I am sure however that if PP gave everyone mammograms, the right would be screaming about it wasting money and unnecessarily exposing women to radiation risk.

HOLY CRAP!!! THe ONLY thing that should influence the decision of the Supreme Court is that which is written in the Constitution!! If the Constitution is based solely on the "interpretation" and "ideology" of whatever SC justice happens to be sitting on the bench, the WHAT THE F*CK GOOD IS THE CONSTITUTION???? Today it means THIS, tomorrow it means THIS, next week it will mean THAT and ten years from now it will mean THE OTHER!!! That is NOT what the framers had in mind AT ALL!! Which is why they did not include the word INTERPRETATION when writing of the powers of the SCOTUS.

Uh...the Framers made it possibly to amend the Constitution. So...if you're so bent about the Supreme Court, interpreting the Constitution and the laws. I would encourage you to contact your legislators asking that they can introduce an amendment which would prohibit the Supreme Court from doing so.

They probably didn't include the word interpretation...because when dealing with law...it's nearly ALWAYS about the interpretation.

Unfortunately for you we, don't live in a black and white world...there are many gray areas in the law. Thus...the laws are interpreted based on ideology...and on the times in which we live and on past rulings. It must be rough on someone who wants to live in the 18th Century to have to live in the 21st.

I think I am going to donate some more money to PP in honor of Mikey.

And then, make a donation to my law school alma mater.

And then add a donation a local youth health care foundation.

It will be a more productive use of my time and efforts.

Unfortunately for the entire country. Were the federal government only to do that which it had the Constitutional authority to do, we would not be in the mess we are in right now.

Nothing of which I have posted would indicate that I am "brain dead". In fact, I am at least offering arguments and precise references to back up what I am saying. Do you believe that everyone who disagrees with you or has a different view to be "brain dead"? I suppose you think the moron who keeps referencing his Willy Wonka is an absolute GENIUS!

The original topic has to do with PP funding and the federal government funding Planned Parenthood. All powers of the federal government come from the Constitution. If the federal government has the authority to collect tax dollars to fund PP, then someone here should be able to show where this power is derived within the Constitution. Therefore, the topic is not being derailed at all.
