Actually, my fear about Ashcroft is that he resigned because Bush is planning to try and appoint him to the Supreme Court when Rehnquist invariably leaves. I hope I'm wrong about that.

I really don't get that rumor. Has Ashcroft ever been a judge? The Senate should never let him pass if he has no experience, and that has nothing to do with partisanship.

As you probably know, it is not a requirement to have previously served as a judge in order to be appointed to the Supreme Court, and, in fact, historically, a number of them had never been on the bench before.

I'm not hysterical, and I'm not saying it will definitely happen--just that it is a possibility. But don't worry, if not Ashcroft, whomever Bush attempts to appoint will be as bad or worse.

as irony would have it, only one member of the current court had no experience as a judge when nominated: rehnquist. no justice since him has been approved without serving as a judge. there is also a possibility that arnold ziffel will be nominated should rehnquist step down or drop dead, but i'm not holding my breath waiting for it.

Gah, I really wouldn't want to appoint Ashcroft based on some of his past ideas of Constitutional interpretation. But maybe I'm underestimating the stupidity of everyone in Washington.

The Supreme Court has been around for over 200 years. In that time, 43 of 108 associate justices, and 8 of 18 chief justices had no prior judicial experience. True, there hasn't been one of that type apponted since the seventies, but the seventies really wasn't that long ago.

My point is not that Ashcroft will surely be nominated, but that it is a reasonable possibility--not a far-fetched hysterical fantasy with no basis in history or law.

He might try to get in someone with an ideological profile similar to Ashcroft, but the man himself is too high-profile and not that popular.

Once again, I hope I'm not overestimating the intelligence and judgement of the folks in Washington.
