I was wondering if anyone has had any experience attempting to gain clearance to use images (photos, image scans, etc.) for CD liner notes, books, exhibits, and so forth... I am working on an exhibit and have been researching and there are some people who will not respond. DeWynters, the logo designers for many illustrious Broadway productions, is one example. I have contacted them, but cannot expect to gain clearance for use of the Carrie logo in promotional materials for the exhibit in question.
I mean, should I be concerned about the photographer of some 50 year old flop like one-nighter Kelly coming after me for using an image on a promo postcard? If I try like gangbusters to find him an gain clearance, can't I claim a good-faith search was attempted? I'm fuzzy on the copyright and fair-use matter here.
