Since I just came from Con Law-
Bush v. Gore
Anyone remember how absolutely, god-friggin-awful this decision was? I don't even mean this in a political sense- just read the thing. It's some of the most convoluted legal rationalization I've ever had the misfortune of encountering. And anytime one of those conservative justices speaks out against the evils of judicial activism, I just want to grab them and point them to the White House, the contents of which are the results of one of the worst cases of judges overstepping their bounds in American history.
Okay, rant over.

Oh and, Plum, the fact that said case outlined how an election should be handled in Florida--and Florida did not fulfill said case's provisions.
So, TECHNICALLY, Florida's votes should have been thrown out in 2004 according to said case.

The Constitution give states jurisdiction over election procedures. The Supreme Court is part of the federal government. Just my two cents.

Uh, but Fiji- the Supreme Court gets authority over a whole lot of state functions if the states are doing them in an unconstitutional way. It's that whole 14th Amendment thing popping up.
If I remember right, the "case" (and I use that term reluctantly here) made by the majority in Bush v. Gore hinged on the equal protection clause, which just cracks my **** up.
