If they are in debt to the point that they can't afford to mount another production or pay salaries, then they certainly don't have money to pay refunds.

The tax deduction for the tickets to a future performance is really a service by the theater company on behalf of the subscriber. The subscriber is in effect allowing the company to re-sell the ticket. The company can't sell the same ticket twice, so the first ticketholder's money gets converted into a donation.

Many companies won't allow post-dated tickets to be converted for tax purposes, and many companies won't do the paperwork if you're not a subscriber.

As for the Intiman, the situation is bad for everyone involved. I'm not sure that they'll be able to continue to refuse refunds legally if they don't declare bankruptcy. Ticketholders paid for a service they aren't getting. On the other hand, if everyone demands a refund, that may force the company into bankruptcy and no one will get their refund anyway. No good options for anyone here.
