Posted: 1/3/07 at 2:23pmIt definitely seems like things should at least be loosened somewhat. I can understand not linking illegal, copyrighted or bootlegged material but there are a lot of things on that site that don't fall under those categories.

That seems to be what TalkinBroadway feels. They still ban linking or referencing bootleg videos, but they now feel television shows and movie clips are fair game.

Well, the key phrase is:
"For now, references to television clips, film clips, and "homemade" video are permitted as long as they do not violate copyrights."
Since nearly all mainstream tv shows and films are copyrighted (and clearly say "all rights reserved"), then wouldn't posting links to them still be illegal?

That seems like a pretty sensible policy as there are a number of studios that are choosing to place TV and film clips on youtube as part of their marketing plan.

So what stops people from TiVo-ing, or recording their favorite TV show on VHS?
I think it falls under the movie rule. You can air the following as long as its free.
Youtube is free, so I'd expect that it's legal.

Under the Copyright Code's Fair Use Doctrine, there's an explicit exception made for "home use" (ie recording films and tv shows to be rewatched within the home and not for charging a fee for exhibition or redistributing any copies, even for free, without permission).

People forget that when they post a message or a clip on the Internet, they are "publishing" it. It's available for all the world to see, free of charge.
That's a copyright violation... if you don't own the material yourself, or if it isn't Public Domain.

Posted: 1/3/07 at 2:45pmThere hasn't been any new legislation for a YouTube exception so far. Though, while many content providers aren't prosecuting or issuing cease and desist orders for every violation (their legal departments would have to work 24/7 with a huge staff to even try to crack down on the millions of clips being used without permission out there), it's still technically illegal to redistribute copyrighted material without permission (which is what You Tube does).

Youtube really is the internet story of the year - if nothing else, for pushing these suddenly very unclear issues to the forefront.

Posted: 1/3/07 at 3:46pmthe additional issue is that these sites have ads on them. So while it's free to for viewer to see the content, the host of the site is profiting from the viewership. "Someone" is paying for you to see the content... and the copyright holders are not seeing that money.

The Fair Use doctrine also allows for the free use of "snippets" that are not a significant percentage of the original work.
So in a written work, if you use 10 sentences from a full-length novel, it is not a significant percentage. But if you use 10 lines from a song or a poem, which would be shorter, it would be a significant percentage, and it would be illegal.
YouTube's attorneys will ultimately have to determine what constitutes "free use" of a video.
