That is gay-bashing, even if the victim was straight and perceived to be gay.
A crime is a hate-crime when a criminal or group of criminals choose a potential victim who is simply part of a group--OR WHO IS PERCEIVED TO BE PART OF A GROUP.
Just curious- has a gay-bashed straight person ever charged an attacker with a hate crime? It would make for a really interesting legal precedent, but I wonder if the straight person would perceive it as a gay-bashing instead of just an assault.
