This will be very interesting. Since marriage is not a jurisdiction of the federal government (not mentioned anywhere in the Constitution) a federal law legislating marriage should be ruled unconstitutional. However, a STATE law?? Under the 10th amendment, marriage would be in the jurisdiction of the states, so Prop 8 might hold up. Like I said, it will be very interesting one way or the other.
