Yes they can and have in fact, as long as the position is open. After Rehnquist's death, John Robert's nomination to the Supreme Court was changed from a regular Justice to Chief Justice by Bush. Bush previously nominated him to replace the soon to be stepping down Sandra Day O'Connor, but that changed after the Chief Justice passed.

Posted: 7/25/08 at 10:37pmJoeKv said what I was thinking. John Roberts is only 53. It's going to be a long time (possibly longer than her own lifetime) if she wouldn't agree to a nomination for anything short of the Chief Justice position, so that was an odd hyperbole on southernboy's part.

Being in the Supreme Court is one of the most powerful positions in the country, and, your effect can last well past your life time.
If Hillary really wants to make sure that women's rights are protected, then put her on the Court. There are a couple of liberal justices just waiting for a Democrat to get in office to retire.
And, while she cannot be Chief Justice, she can be one hell of an advocate. I think it may be even easier for her to be confirmed if it is for something other than Chief Justice.

Papa, actually, if McCain wins, who knows what he will do.
For all I know, his head will spin around and out of spite to the far right of the Republican party, he might just nominate her - especially since he apparently likes her (in a professional way).
As much as Obama is an unknown, Johnny Mac is a huge wild card. He has flipped and flopped on so many issues, you have no idea what you are getting.

Wall Street Journal says Obama has a shortlist and Hillary's still on it.
None of the rest of the possibilities delivers half the party and a sure landslide.

Papa, I honestly don't know what McCain template is.
I am hoping it is more Kennedy than Roberts if he wins, but who knows.
I honestly think Obama will take this though. I think the debates and whatever "town halls" they have will be very important, as will their running mates.
And, while the campaigns will not run this ad, I have already, in conversation with people who supported Bush in the past (and who would have voted for Clinton over McCain), asked "Do you really want someone who survived 5 years of torture to be the person with his finger on the button?" And co-workers in Iowa of all places have said that they have discussed this very issue, and they are no comfortable with that experience, his apparent temper, and his age.
Also, the polling does not factor in cell phones, which probably skews greatly towards Obama, so I have a feeling that his lead is actually a couple points higher than polling shows.
Who knows though - I think running mates will be important for both of them.

i categorically dispute that line of thinking ywiw and have spoken to no one -other than you who bring it up every 10 posts without fail - for whom it was an issue. i really want the democrats to make an issue out of it as it will backfire spectacularly as they are painted as cowardly america-hating swine who demean the sacrifices of a true american hero. not that it's fair, but that's how it will be portrayed and it will work like gangbusters at destroying bammy. if i had the cash, i'd run the ads myself right before the democrats' convention and allow the implications to taint the entire thing.
but really, you're asking people who were already going to vote against him? what the hell does that show?
oh yeah, the cell phone argument. i remember the same point being made in '04. how'd that work out for lurch? i am one of those people who have no landline, so don't assume that they are all bambots.

No, these were people who were traditional Republicans, but they are so sick of Bush, that it is blowing back on McCain.
The dems would never run that ad, but it will be chatter under the radar. People are talking about it, but unless a 527 runs an ad, I cannot see the dems officially doing anything about it. Talk radio may make fun of him, but officially, the DNC will say it is not a fair line of attack. (wink wink, nod nod).
And, if you want to go back to 2004, we can discuss tactics in certain states that suppressed traditionally democratic votes. Or, we could say that in 4 years, more homes have migrated from landlines to only a cell phone.
None of this is an exact science, which is why it is all so interesting. Who do you really think McCain will pick as VP?

Hmmm... MSM keeps saying Romney, which I cannot really imagine.
There has also been an undercurrent of Lieberman, which I thought would be silly.

no way he does lieberman. i really don't see him taking romney and think that most of the romney talk is coming from former romney supporters (which are legion in the gop punditocrtacy, see crash novak). the silliest argument i saw was that becuse romney might deliver michigan, he ought to be the veep. hey, yeah, let's pick a guy for one state that is not even guaranteed. stupid. romnney brings the baggage of making them the flip-flop ticket. the guy hasn't ever made a policy decision that he wouldn't abandon. and there's the whole mormon thing.
the dark horse that i have heard mentioned a few times on the gop side is bloomberg which makes me puke. i don't think it's workable though because he's too far to the left to be palatable to the base and he really brings nothing (but money...and media).
if bammy doesn't go with richardson i think he goes with sebelius which i think is a horrible mistake and a real slap in the face to a lot of democrats. but i don't think he really cares. i truly think that he and his people believe he has it in the bag already and that they can pretty much do and say whatever they want from this point on with little or no consequence.

Sebelius would be a mistake in my opinion. He needs someone with foreign policy experience who will compliment him, not be a "ditto" to him. I have heard a few rumblings of a joint ticket with Hagel - but he is too far to the right on everything but Iraq to be viable.
I am not a huge fan of Richardson, but he would be better than Sebelius, in my opinion. Clinton is still a possibility, but I think it is unlikely (though I wish it would be the case).

i dunno, ywiw, after this trip, i think it's pretty clear that bammy needs only bammy. whoever he picks is just a complementary choice who won't overshadow him and draw attention away.
