Eviction of a tenant is a lengthy process. It does not matter if he is on the lease or not. If you have taken rent money from him, he has established residency there. I would begin your procedures, based on your specific city ordances, ASP. Police are not going to do anything unless you can prove his criminal behavior and then thats iffy. Getting him out of the premises is all done through the courts which can also be expensive. If he states he will leave on May 31, get in writing and although it maybe difficult, be accomadating to him. It could take months for you to get him out legally. If you evict him "illegally" he can turn around and sue you civilly. Either way you're kind of SOL. I have a friend who rented his house, after the first month, the renter stopped paying rent. Finally left, but left all her belongings inside the house. He put her things outside and changed the locks. She called the police on him and he was forced to give her a key to the new locks and put her belongings back in. It took three months to get the legal eviction, at a cost of $1400. He has a judgement against her, but good luck getting that. Also stop telling him what you are or aren't going to do. The best defense is suprise. Again, like Taryn stated, it is up to your specific city/county ordinance to get him out.
