So what are the laws for scalping tickets in NYC/NYS? Not looking to get into a moral discussion, but approached about paying for tickets to a charitable event and they're asking for a good sum above ticket value. Is the sale legal? Is there risk outside of purchasing a bogus ticket?

Not quite sure what you are asking. Doesn't pretty much every fundraising event charge a higher ticket price than "face value"? For example, NYTW added a performance of MERRILY WE ROLL ALONG, and every seat was $1500.00. The portion above the actual ticket price is tax-deductible. They were in no way "scalping" or doing anything non-kosher. Actors Fund/Entertainment Community Fund performances usually operate in the same way.

To clarify, the private reselling of a charitable ticket for personal gain.

I don’t believe there is a law regarding how much a ticket can be resold for. The state of New York requires that ticket resellers be licensed, however, The NYC govt page on ticket resale says “A license is not needed for selling tickets originally bought for personal use.”
Someone who is selling you a ticket they originally bought for their own use can charge however much they want, and you have to decide for yourself whether to trust them.
Also, I’m not a lawyer. I just did some light googling.
