I may be wrong about this, but I think the issue with Forbidden Broadway was that they were using the music for a set show, not either a cabaret/concert/variety or a "one off" parody. It's the difference between having to pay ASCAP or BMI a "usage fee" for a song and having to actually secure the rights to use it for a "book show" (or set show).
Thankfully, with Forbidden Broadway, nearly all estates concerned not only "waived" the rights, but they gave them their full blessing to use whatever they wanted.
Imitation is the highest form of flattery ... for some, but not all.
