This bothers me tremendously. What if the situation involved someone who claimed to be spitting on a sign advocating marriage equality at a rally, but instead hit the sign carrier?

However innocuous the action of spitting may appear, it is a physical invasion into private space that crosses a boundary that should be sacrosanct in a society that claims to honor free speech.

I see nothing to celebrate in this at all - in fact, I find something to worry about, and question the double-standard of those who scream for equality.

I agree with Q as regards to the letter of the law, but I can't say I'm morally offended by what happened to Ms Phelps. I don't agree that spitting on another person, as abhorrent an act as that is, constitutes assault or battery. Some lesser charge surely would be sufficient. The way I see it, this was a frivolous lawsuit, something the Phelps are well-known for. There is also a legal term known as "fighting words", something I'm surprised that the Phelps aren't called on more often. I would like to think the jury factored those things into their decision.

I find something to worry about, and question the double-standard of those who scream for equality.

To me, that sounds like the old "If you're supposed to be so tolerant, why don't you tolerate my hate and discrimination?" trope that's trotted out by homophones (usually of the fundamentalist Christian variety) all the time.

It should also be noted that no where in the article does it actually confirm that Shirley Phelps was spit upon (and the title is also a misnomer, because that's not what the article actually says), so perhaps the jury just simply couldn't convict him of battery beyond a reasonable doubt.

Honestly, if someone got away with spitting in Shirley Phelps, I'm totally okay with that. It's not like the dude is OJ Simpson.
