He can sue...doesn't mean he will win.
Not many people know this:
Mel Brooks did not actualy make up the scene in his movie History of the World Part I when Moses comes down from the mountain and bodly states, "I have these 15," drops a set of 5, "10 commandments." Turns out there were 15. The 15th we have discovered states, "Thou shall sue whomever thou wanteth to sue." Of course, America adopted this commandment.

Actually, my understanding is that, when they originally pitched it as a tv show (which was its original intent), Gary wanted to play himself.
He even said he would do it onstage but they went with the obvious casting of someone so NOT Gary to avoid making the show about Gary Coleman.

Wow. He is really considering Legal action! That would be the best thing to happen to Avenue Q. The clips of "It sucks to be" would be shown on CBS, NBC, CNN, all of them.
Avenue Q ought to let him play himself for a few shows, that would be awesome.
