This story really bothers me. It is almost impossible to spread HIV via saliva, there has never been a documented case of the virus being spread in that manner.

it goes back to intent. is the man who tries to poison someone guilty of attempted murder if the poison is defective?
I assuming they would've had to prove beyond a reasonable doubt that he was trying to give the cop HIV when he spit on them. How the hell would they prove that?

I mean, if I had strep throat and spit -- technically, strep throat CAN kill you, and you actually COULD get that from spit...would it get the same sentence?
