Absolutely correct, Q. Point being, legally, using "fighting words" (often including hate speech) gives the court an excuse to basically say "Well, you provoked them beyond reason with your language, so you got clocked? Too bad - you deserved it".
I still find it ridiculous that anyone thinks throwing a drink it a violent act, because that makes me think you have led a very sheltered life. Is it rude? Certainly. Out of bounds of normal societal behavior? Of course....but violent? Gimme a break.
I would love a link to Websters referred to that claims throwing a drink is violent.

And yes, I DO make a distinction between verbal volleys and crossing the threshold into something that actually contains physical agression - I don't care if she threw feathers at him. It's an agressive act that takes it to the next level.
Eh. Fair enough, but I disagree. I think initiating relentless verbal harassment is worse than spilling a drink over the head of someone who initiated relentless verbal harassment.
Drawing clear lines against physical action on another person is responsible. I can agree with that academically, but not really on any other level.

I've dealt with a fair amount of verbal abuse in a variety of situations, and my choice is to always turn and walk away - and I've never been in a fight because of that. That's my reality, and there's nothing academic about it.

Your reality is not everybody's reality. Which isn't to say that you're not right, but that doesn't mean it doesn't sound smug.
If you are going to pour/throw a drink on someone, make it a Grasshopper, or a Pink Flamingo...
They are full of sticky goodness that forces the person to leave the club because it feels gross.
I've done it before, and I'd do it again if the other person doesn't stay out of my face.

Out of curiosity, what was gained by her action? Is his mind changed? Was he publicly humiliated in a way that will cause him to have a fit of introspection? Does it become a rallying point where people will say, "Oh, look, they can't be bullied - they'll throw their drinks at us!"?

Yeah, I guess so. This implies that what I was saying was advocating violence, which is also smug. I just think "that's my reality, there's nothing academic about it" and specifically mentioning her "self control" sounds smug in a "this is easy for me, it should be easy for everyone" way.
Especially when discussing something at the very lightest part of the violence gradient. I have a hard enough time considering dampening someone as legitimate violence, let alone seeing it treated with the same earnest disapproval as a bar room brawl.

I would imagine she felt better - something that doesn't always happen if you always walk away. And they probably able to continue the show in peace.
