I love how progressives use everything including the kitchen sink to bolster their Constitutional "theories" , they use everything EXCEPT the Constitution itself!!
You can bring in all the letters and case rulings you want, but when you look at the ACTUAL CONSTITUTION and what it ACTUALLY SAYS, all your arguments fall flat. I don't give a RAT'S ASS what Jefferson wrote in a letter. I don't give a RAT'S ASS what the SCOTUS said 50 or 100 years ago; they've been wrong before, they'll be wrong again. (Anyone want to argue that "separate but equal" was EVER Constitutional, even after the SCOTUS said it was?) I care about what is written in the Constitution!
Again, the 1st Amendment limits THE CONGRESS. It limits it from PASSING A CERTAIN TYPE OF LAW. It limits it from ESTABLISHING A RELIGION. Hanging a portrait of Jesus in a school FAILS on all three counts!! Now you add the "prohibiting the free exercise thereof" (which the people in that district are clearly doing) and it is very clear that this does not pass the smell test of being UnConstitutional.

So we are not allowed to interpret the Constitution (which by the way, any one who is SANE would clearly see what the Constitution says about Freedom from religion) but yet you nut jobs can do whatever you damn well please in the name of the document? also, is it okay then for schools to have portraits of joseph smith? do you affirm that he took dictation from the angel moroni or didn't he? do you agree that jesus will return to missouri and split the mount of olives in two?

NO you CANNOT "interpret" the Constitution. If you "interpret" the Constitution it loses all meaning; you can INTERPRET it to mean whatever the hell you want. When you "interpret" The Constitution you BRING meaning to it, instead of TAKING meaning from it. There is a HUGE difference.

MARBURY v. MADISON (1803), was an inconsequential case before the Supreme Court but it set the precedent that established Judicial Review, meaning the Supreme Court gave itself the right to interpret the Constitution of the United States of America. Nowhere in the written Constitution is the Court given the right to interpret the laws of the United States but it is established precedent and it would take a constitutional amendment to deny the Court their right to interpret the Constitution and that will never happen. The landmark decision defined the boundary between the constitutionally separate executive, legislative, and judicial branches of the American form of government.

The SCOTUS --nor any other branch of the federal government-- is NOT supposed to give itself power. When the branches o fthe federal government are "giving themselves the power" to do things that are NOT in the US Constitution, we are in DEEP DOO DOO! (And we clearly are that!)

WOW!! You CLEARLY have no idea how the Constitution works. It does not tell the feds what they CAN'T do, it only tells them what the CAN do. If it is not in there as a power of the federal government, then the federal government CANNOT do it. Thus the rationale for the 10th Amendment which reads, "The powers not delegated to the United States by the Constitution, nor prohibited by it to the States, are reserved to the States respectively, or to the people."
