I'm off to bed *grumbles* granted that I actually fall asleep, since my friend James had to send me that urban legends link and I had to watch it, and now there's no chance that I'll actually sleep, since I'm freaked out right now. WHY am I cursed to love supernatural things in a wimp's body? WHY?

I don't think the defendent himself should know...I mean if the defendent gets loose (bail, not-guilty, etc) and really did commit the crime, he knows all this personal stuff.

But there is a law that both parties are allowed to all facts that are concerned to the case (My Cousin Vinny).....

However, we also reach the problem of Hearsay (sp?).

jmac, yeah, but the issue isn't so much hearsay, but the idea that, let's say the complainant is being molested, the accused may have access to school records and be all "the accused is not credible because she does badly on school." or, let's say the accused get into psychiatric records and claims that the complainant may suffer from delusions or schizophrenia, or argue that hte mere fact that the complainant is seeking therapeutic treatment may discredit her.

yeah - both parties get info regarding the CASE...

called disclosure.. (right tiff?)

but - her personal medical records have nothing to do with the case ...

If she accused someone of rape before - that could be pertinent and then the rape kit could be submitted into evidence... but her personal records... NOT! (her having a pap smear the year before is not the same thing - even an abortion - her business)

Yup, disclosure. (Go on with your bad L&O-luvin' self!) Okay, but if there's an inalienable guarantee of doctor-patient confidentiality, doesn't this give the complainant the freedom to say whatever and get away with it? What if the complainant admits to her therapist that she fabricated the claim, or that her memory of the events is fuzzy and maaaybe it wasn't really the defendant who raped her, etc...what should be the limitations?

not possible - because then the doctor becomes and accomplice - and is liable for prosecution....

same thing with a lawyer who cannot willing assist a criminal act..

(granted defense lawyers have a LOT of leway....)
