Disagree if the partner was unaware of the situation.

To knowingly put another person at risk without their consent
is criminal.

It's Russian Roulette without the other player's knowing that's what the game is. They could be assuming there are no bullets in the chamber and you know it is highly likely that there is.

No I am not kidding. If in 2005 you are having unprotected sex , you need to assume part of that responibility.

Why is anyone having sex without protection. It sounds like someone was careless and now is looking to blame another for their mistake.

You know what, as a gay man, I'm not entirely unhappy about this. I know the sex was consentual, but the epidemic is so out of hand that I think extreme measures need to be taken. Maybe it'll at least be a good scare tactic.

if you knowlingly put someone else in danger, you shoudl be held accountable for it. even if the sex was consentual, i doubt if the other person knew he was hiv+ he would have had unprotected sex with him... it's his responablilty to tell his sex partners or at the very least, use protection.

Wait. A wife has unprotected sex with her husband. He has been sleeping around and knows he's HIV positive but has not revealed that to her in order to hide his infidelity.

You're saying that he shouldn't be held liable for risking her life and possibly the life of a child?

We are talking about two male gay adults. I don't go to bed without a condom. I don't care if you are HIV+. I don't ask, because I don't need to know. I treat every casual encounter as if we both are positive. That means even if he wants me to put him at risk, I won't.

But your conduct is not practiced by everyone and you didn't address my scenerio.

Why should a faithful wife or husband always assume their spouse is putting them at risk. And, if they intend to have children, then condoms are not practical.

Ugh. Very touchy subject.

As an HIV+ individual, I always disclose. Always. It surprises me that people would've been willing to have sex with me without asking.

If you don't ask, and have unprotected sex, yes, you deserve some of the responsibility. Now if you ask and are lied to...

If you put someone in danger without warning them first, you're held liable. In all kinds of situations. Am I saying that both parties don't need to think of protection when having sex? No, of course not. But the solution isn't to just let someone get away with spreading a deadly disease to his or her partners. This is a public health hazard that extracts untold costs in human suffering and dollar expenses.

captain I am completely missing the point of your posts. I would love to understand what you are trying to say.

By the way I do have oral sex with condoms. HIV is not the only thing out there. Herpes...

beacon1 my post is in response to an AP article about a gay man. Couples in a marriage have the same responsibility we all have. But let me just say this, in light of all the cheating that goes on in straight and gay relationships, If I were a woman I would always have protected sex with my husband.

And what if you decide to tell someone and he says "I don't care" and then the condom breaks and since the law exists , he decides to sue you anyway?

What proof does the HIV+ person have that he disclosed?

Then it becomes (s)he-said-(s)he-said, but that doesn't mean that statutes against this behavior shouldn't exist at all. Plenty of crimes often come down to conflicting testimony.

If a man is shot dead with a gun that has two men's fingerprints on it, how can we know who did the shooting except through he-said-he-said? Does that mean murder shouldn't be a crime?
