re: unless you rape someone...

Now that example would be different than the previous examples, wouldn't it?? That example is not the same as a person letting a poz person sleep with them without a condom.

The details are extremely important.

Okay, the case I'm finding right now (which may or may not be the one I'm thinking of; I can't remember) is that of Nushawn Williams. He knew he had AIDS, received counseling about all the dangers of it, and had unprotected sex with 48 identified partners. (It was a lot more than that, really.) 13 tested positive for AIDS. He was charged with reckless endangerment for having sex with a 15-year-old in the Bronx, the first time that charge was brought in an AIDS-related case in New York.

I think it might be better not to have a law devoted especially to HIV cases. Reckless endangerment has a higher burden of proof, but it's appropriate.

So, the only charge was with the 15yo? And that makes sense as not only did he commit statutory rape, but we don't expect minors to make responsible decisions regarding sex per age of consent laws.

Those other partners were stupid for not using protection. The only way it could be worthy of being a crime is if you can prove he had motivation to infect others.

Yes, the details are important; and I'm glad you recognize that, and of course there are probably instances where a law like the one described in this thread are not appropriate; but I think there are some people who should be punished under the law for such despicable acts, whether under reckless endagerment or some other statute.

re: unless you rape someone...

That we agree on I think, Pinguin. I don't think anyone disagrees that a poz person who lies about a broken condom or intentionally tampers with a condom is guilty of a crime. I don't think anyone disagrees that a person who has motivation to infect others is a criminal. I don't think anyone disagrees that a trusted partner who cheats around and brings HIV home to their partner is a criminal.

But the debate seems to lie in those instances when a person doesn't disclose their poz status (IF they even know they are poz) and has bareback sex. And when, it is CLEAR that one should never let a non-trusted partner not use a condom with you, I do not see how people can not take responsibility for themselves.

We live in a blame anyone but ourselves society these days--and it's absolute BS.
