re: Unless you rape someone...

I wish that there didn't have to be laws for stuff like this, but there are, obviously since this guy was arrested 3 times for it, people out there who don't care whom they give HIV to. It is sad that legislators have to get involved in people's sex lives, but this only affects people who are dumb enough to have sex without a condom. And in this day and time anyone who doesn't use a condom with an unknown or unmanogomous (sp?) partner is dumb. Its not just sex, it could be life or death. People don't seem to think about that when they are horny.

re: Unless you rape someone...

In the 90's, TB patients in New York City who refused treatment were forced to go into a secure hospital ward and be quarantined. Why? Because they were knowingly spreading disease and that just couldn't be allowed for the sake of public health.

TB is spread through the air when people cough or sneeze. The quarantine was necessary to prevent the spread of the disease. HIV, on the other hand, is spread through sex most of the time, and sex is given some legal respect. So people are arrested after the fact, and only for knowingly engaging in behavior that could spread the disease. Sounds fair to me.

Personal liberty vs. public safety is one of the oldest legal debates out there, and a balance must be struck that doesn't go too far in either direction. I don't think this law tilts the balance too far in the "public safety" direction.

re: Unless you rape someone...

Whoa. I protect myself because my first relationship was with a wonderful man with full blown aids. We cared for each other and made love constantly. I learned how to eroticize condoms and safer sex practices.

I don't want to know your status if it is a one night stand. If you want to tell me, that's fine but my resolve to have safer sex is solid.

Does anyone think comparing the transmission of TB and AIDS is wrong.

re: Unless you rape someone...

What? NO!

You should always be safe until that point when your relationship with someone is trusting enough. But full disclosure, for me, is not only necessary, but fair. And not only for the other person, but for myself.

The bottom line is you shouldn't be having unprotected sex.

If no one asks or discloses and you still have unprotected sex, I think the blame is 50/50. Yes, the positive person should disclose, but it's the negative person's responsibility to protect themselves. If one person asks, and the positive person doesn't disclose, then I think most of the blame falls on the person who lied.

re: Unless you rape someone...

I think Chita's concern, if I may impose on that, is that most of these kinds of laws are used against gay people only. Example: right now NYC has been using the archaic Cabaret Law to shut down bars--but only GAY bars. Another example: sodomy laws were used against gay men--rarely if ever straight people.

And furthermore, sentences are usually harsher for gay men on laws like this.

And, maybe no one is asking for HIV+ men to be quarantined, but it sure sounds like you are asking them to stop having sex. Well, that's not right at all. Use protection or don't engage in promiscous sex.

Disclosing doesn't mean ****.

re: Unless you rape someone...

WRONG KEL

you said "HIV isn't something that you can get treated like some STDs. It is permenant and you will die."

wrong, not always the case. I was diagnosed in 1991, and have never had a problem. Many people do not even move to AIDS, especially those of Scandinavian descent, as there is a gene they carry that seems to inhibit the disease.

what you posted is ignorant.......I love you anyway, but please......do not say that again

HIV is manageable NOW........your view is from 1985...time to update it

I thought HIV tests could be up to 6 months behind...

Yes, chita, seroconversion.

Also, being in a POZ/neg relationship is sometimes called a sero-discordant relationship.

re: Unless you rape someone...

If the law is being unevenly enforced, that's a problem. Is that problem inherent in the law itself, though?

Legally, it's problematic that homosexuality isn't a suspect classification nationally or in most states as far as I know. So if the law is unfairly enforced mostly against gay men, I'm not sure anything can be done about it.

re: Unless you rape someone...

I know that its just TV, but has anyone seen the Law and Order SVU Episode where in the end this guy had been on the DL and was cheating on his wife with a gay man. He found out that the guy had HIV and he had brought it home to his wife. His wife had to come to terms with how she was going to be able to tell her 4 or 5 year old daughter not only why her daddy was in jail (for the murder of the man who infected him) but also that mommy was sick because of it. The guy who gave that family HIV was spreading it around like crazy just because he could and he didn't care who he gave it to. People like that need to be locked up. Don't stop having sex, but be careful.

re: Unless you rape someone...

Man, people are going to hate this:

1) ASK people about their HIV status? That is useless. You don't think men lie to get laid? Believe nothing.

2) Yes, to knowingly infect someone is monstrous. It should be a crime.

3) Yes it takes two to tango. You sleep with strangers, you take your chances. Protect yourself. Everytime. But some of us have extra responsibilies. If you know your car door pops open whenever you make a turn, you MAKE SURE your passenger wears his seatbelt.

4) The idea of legislating sexual activity doesn't thrill me. This isn't TB where you can be infected in a million different ways. But sadly, 25 years later there are still dizzy queens out there who are thinking with the wrong head. Since they obviously won't act responsibly for all the good reasons there already are, I wonder if jail will make them fly right? I guess we have to give it a shot. We've already made some adjustments to protect ourselves and those we care about-- this doesn't seem to be that dreadful. It's a law against something I'd never do, anyway.

Daydreamer--the latest tests are at 3 months now. Just got tested again in June at the Geffen Testing Center/GMHC. What's great is that it was same day results.

Wow... that's excellent. Gone are the days of the excruciating 2 week wait to get your Elisa test back, and if that was + another week or so for the Western Blot.

that week long wait back in the days was grueling.

so if you don't have sex for 3 months and have a test and it's - , you are clear?

Elphie- Thanks for the info, I honestly didn't know that. I appreciate you letting me know and I am really glad that everything is going well for you. Living in a very umm..."uncultured" and somewhat homophobic area of the country keeps me from always being up to date. I edited it. re: Unless you rape someone...

The scary ones are the 'bug chasers'... who want to get infected and just get it over with. It p's me off.

"Oh, I can just take meds and live a long time"

God only knows how much I wish I didn't have to remember to take my meds everyday, and go to the dr. every 3-months and get poked and tested.

And let's not forget all these men and women having unprotected sex in a time of HIV and AIDS could be a symptom of an insidious disease called self hatred.

re: Unless you rape someone...

Yep! I was in a monogamous relationship. Got my test--we went hope and did the nasty the old fashioned way! re: Unless you rape someone...

But, then we broke up, so it's back to safe sex!

I don't ask status. It doesn't matter--I treat every guy I fool around with as if he could be poz. The only benefit I can possibly see in knowing that a guy is poz is that one would not "make mistakes"--but you shouldn't "make mistakes" anyway.

re: unless you rape someone...

devil's advocate.

two people decide to be monogamous and promise if one of them errs, he or she will tell the other.

One of them errs but all of a sudden reality sets in and human nature takes over. The person who cheated is embarassed, mortified and can't gather the courage to come clean.

My question: Is it not better just to have safer sex with everyone, longterm or short term, until a cure for this virus appears?
#74

re: unless you rape someone...

well, yes. There are people who despite monogamy--never stop having safe sex.

That's a big question for people, gay or straight, to figure out for themselves.

I agree that you need to understand that if you are having unprotected sex then you are at risk BUT to know you have AIDS and not tell your partner is absolutly horrible and the guy deserves to be punished.
