if you can't find one in an actual Barnes & Noble, they're very prompt about shipping things with online orders. I ordered mine this past Monday, chose the cheapest shipping method and got it on Thursday.

Phew, my mom now suprised me with a copy of the book! She said she was joking when she said I couldn't get it for a month. I'm so happy!

My Borders refused to give it to me until the 7th, and some Barnes and Nobles have been doing the same, but the rest are selling. Definitely call before going for that reason alone.

Is it technically legal for stores like that to sell it before the release date? It seems unusual -- I know with movies and CD's, they won't even give them to you if they get them in like a day before.

No, it's not. I know that I've asked my Barnes and Noble for books before and sometimes they told me that they had it in the back but weren't allowed to sell it until the next day or whatever.

heh...when we got the "Half-Blood Prince" books in, all the boxes were printed with "Do NOT open until July 15th!!!!!!" (or whatever the release date was)

It shouldn't matter if the book is popular or not. A lot of times the book I wanted was a five dollar paperback that was a part of a series and they still wouldn't sell it.
