joe, you're not alone in wondering and, in fact, this very question is being debated throughout the media and in the corridors of power.
it's even brought long-time enemies together.
the thing that a lot of people are arguing is that so many seem to see being called a gay a horrible insult; like being called gay or lesbian is like being called a child molester. the vehemence of the response to questions about her identity - when much of the very case being made for her confirmation rests on her personal story since she's such a blank slate on the issues - has been stunning. "she's being slimed by reprehensible persons who must be silenced!"
i never knew being gay was such a horrible thing.

I really, really, REALLY wish the question were NOT "Is she/he gay?" but "Is she/he closeted?"
THAT'S the real issue.
I couldn't care less about her (or anyone else's) sexuality. When interviewing a prospective employee, I don't ask him or her if their married, gay or straight, or if they are religious. I've never understood the fascination with other people's private lives. If a public person wants to maintain some privacy in their life, and it has no impact on their profession, then it should remain private.
That said, the White House handled this horribly. Their response should have been, "the sexuality of any nominee should never be an issue". Instead, they treated it like it was a malicious accusation, and provided a denial.

Gay, straight or otherwise she has stated "gay marriage is not a constitutional right."

If you asked me the question 'Is gay marriage a constitutional right?', I'd say no. It's simply not listed as a right in the Constitution.
BUT...a spectacularly solid case can be made that the right to marry must be extended to couples of the same gender. It's the interpretation of the Constitution, based on precedent, that could (and should) extend marriage rights (there is no such thing as 'gay marriage'. There is only marriage).

Wow- I had not thought it possible think any less of Andrew Sullivan, he of the relentless "Is she or isn't she?" drumbeat. And yet here's what he says about "outing":

Yeah...I read that one today and nearly gagged. How DARE we be so cruel to the creator of NARTH and those who literally work to make the lives of gay and lesbian Americans worse. It's just so CRUEL, Andrew.

Yeah to say that Rekers or Craig deserve to be protected and Kagan deserves to be scrutinized seems to me to be the most indefensible stance ever- especially if she, as seems increasingly plausible, is a nice hetero gal who never found the right man.
Not sure who released it, but an older picture of her playing baseball was released along with the question about her being gay. They showed it this morning on "The View".
