He said his group plans to appeal on the issue of 18,000 marriages that the court ruled will stand as is.
I'm not sure what this means - since the ruling was on a question of state constitutional law, there isn't a higher court they can appeal to. Unless by "appeal," he means they will pursue another ballot question specifically designed to invalidate the 18,000 marriages. I don't think such a question would succeed. We really will prevail on this issue; it's only a matter of time.

The Court even changed sides on the issue!
"This Supreme Court, which only 12 months ago ? last year in May ? ruled that it is a fundamental constitutional right that marriage equality extend to gays and lesbians, did a flip-flop. This so-called ruling by the California Supreme Court will ultimately be condemned by history," he continued.
Although happy that his marriage has maintained its legality, Takei will continue to fight until the vote is changed!

Posted: 5/26/09 at 6:39pmSorry George doesn't understand the California constitution as well as he understands Tribbles and transporter technology- The Court ruled a year ago that the California constitution said that gays could marry just like straights. Prop 8 changed the constitution to say they couldn't. Today, the court ruled that the people do have the power to change the constitution just like that. The court didn't change, the constitution did.

You know, I skimmed the opinion again, and it appears to me that the only thing that the Yes on 8 folks got was the word "marriage."
The opinion seems to support a distinction between marriage and a commitment contract and the underlying rights.
I think that this was a very narrow opinion, and there is actually some good language in it:
For example:
In sum, although Proposition 8 changes the state Constitution, as interpreted in the majority opinion in the Marriage Cases, supra, 43 Cal.4th 757, to provide that restricting the family designation of ?marriage? to opposite-sex couples only, and withholding that designation from same-sex couples, no longer
violates the state Constitution, in all other respects same-sex couples retain the same substantive protections embodied in the state constitutional rights of privacy and due process as those accorded to opposite-sex couples and the same broad protections under the state equal protection clause that are set forth in the majority opinion in the Marriage Cases, including the general principle that sexual orientation constitutes a suspect classification and that statutes according differential treatment on the basis of sexual orientation are constitutionally permissible only if they satisfy the strict scrutiny standard of review."
This is means they get the word marriage, but not the rights underlying the word.
Regardless, let's hope that someone competent works to overturn 8. But, the decision is not a dark or as stark as it could be.

It will be a cat and mouse game until it can go to the US Supreme Court to have a final judgement made that will apply the US Constitution.
Otherwise, state by state there will alternately be referenda to allow it, then likewise to disallow it. Not a fun game.

IMO, most gays are getting exactly what they deserve. The self righteous here will bash me for this, but the sad truth is not enough of the gay community really cares about gay marriage OR gay rights. They're either too afraid to come out of the closet or are just plain apathetic. When most gays decide that enough is enough, decide to come out at work and to friends/family/neighbors, that's really the only way gay marriage has any hope of passing. Those with hopes that some amendment will pass next year are seriously deluded IMO.

I agree with you. Tonight, I saw too many lazy fags sitting around bars. They weren't there to march. They wanted to stand around and see who they could take home.
And right outside, thousands of people were marching by for their civil rights.
They couldn't be bothered.

Ted Olson. Also known as George Bush's Solicitor General. Also known as the guy who represented George Bush at the Supreme Court in the Bush v. Gore case. Also known as Mr. Burns. The man is pure evil. And he's now representing a gay couple in a legal challenge in federal court to overturn Prop 8.
Just called Joe. We're both speechless.
It's difficult to explain in words how much each of us loathes Ted Olson. Of course, not any more. But you get the picture. It doesn't get any more conservative and nasty than Ted Olson. And now he's supporting gay marriage. And not just supporting it, but putting his legal muscle behind it.
First off, thank you Mr. Olsen. Seriously. And to our readers, this just goes to show you that even I can be fooled into thinking that some people are too far gone. As I've written on this blog many a time: Don't write people off, and don't mock people who reach out to the enemy. You'd be surprised what sometimes happens when you treat even bad guys with a modicum of decency.
Secondly, Ted Freaking Olson is now better on gay marriage than our president - than most of our party. Well, to be fair, let me be precise - Ted Olsen is now better on gay marriage than our president claims publicly to be.
At what point will President Obama realize that the year is 2009 and not 1993? America has become accustomed, inured, and possibly even bored with all the gay rights victories of the past five years. They just don't care any more. And I mean that in a good way. Gay marriage is bursting across the land and the American people have shrugged. They just don't care. So why does our president? Why do he and his advisers seem to be treating gay people and their issues as, at best, an embarrassing inconvenience?
Some realpolitik Iago has our President's ear. He's clearly convinced Obama that gays are the third rail, to be avoided at all costs. It's unfortunate. Not only did Obama openly campaign as a friend to the gay community, and iterate numerous clear-cut promises to act on behalf of our civil rights, but forget the politics for a moment. We're talking about people's lives. We're talking about millions of Americans. We're talking about a President who claimed - pretended? - to care about us. Who claimed to be different.
Not looking so different any more.

I actually have no friggin' idea what Obama thinks about the issue. I do know he's not a fan of gays though. So my conclusion is that he agrees with the ruling.
