Those 18,000 are entering a legal maze. They're going to have to prove their marriage is legal everytime they want to apply for a loan or partake in any benefits that marrieds are allowed.
At least they have a famous face (Ellen) to speak out.

If they had invalidated the 18,000 marriages already on the books, Ellen DeGeneres' marriage to Portia de Rossi would have been among them. Imagine the impact that would have had (and not just among "those gay people")
I would have thought "Oh well, it's a shame for Ellen and Portia, but they are in a position to create their own safety nets." My concern would have been (indeed still is) for the non rich and famous gay marrieds.
Although I don't understand how the marriages can be legal if gay marriage is not. I mean, I do, but I don't.

I'm so proud of my cousin and her lover--and Ellen and Portia--and the 17,998 other couples in California who got married when they did.
The legal morass this ruling creates will mean more court cases, so while this feels like the final word, it's not.

Posted: 5/26/09 at 1:25pmWhile this is obviously very disappointing for now, the fact that the 18,000 existing marriages were allowed to stand will make it easier to overturn Prop 8 at the ballot box, which is ultimately what will happen.

I was just given a better understanding of how the marriages remained legal. As I understand it, since this decision was about upholding, Proposition 8 the marriages that were performed before it passed were and are still technically legal.
That said, it seems they've essentially created a separate by unequal class such as those they are legally gay married.

PJ is right. The fact that 18,000 marriages were allowed to stand creates a big legal oppertunity to get Prop 8 upended.

Sam Harris has put himself in the front of this issue and as much as I like him he can be a bit off-putting and "in your face". That can, often, turn off those who are not on your side. I think Ellen handles things better and can do more for the cause.

Interesting statistics in this LA Times article:
* Proposition 8 passed with only 52% of the vote.
* California has more than 100,000 households headed by gay couples, about a quarter with children, according to 2000 census data.
* The California Supreme Court is the only state high court in the nation to have elevated sexual orientation to the status of race and gender in weighing discrimination claims.

This was a really bad ruling. Not b/c I disagree with it (which I obviously do) but b/c of all the problems and loopholes it creates.

Taz - I think the loopholes are there on purpose - leaves the door open for further challenges.
