Unfortunately it is legal. As stupid as it is to sell something that you can get for free at almost any place within Times Square. If you live out of state and can get to NYC, I'd rather buy playbills than those flyers.
People also sell the discount slips that you can get for free. They go for about 5 bucks on Ebay. What a rip off.

I found a good deal at my local Walgreens store for $5 each and the tag says it sells originally for $19.99! What a steal!!!!
