If the school merely sent a letter home to the family stating that it was in bad taste that would have ended things. Perhaps.
Freedom of speech even includes hate speech. All you can do is to wear a t-shirt that says 'love thy neighbor'.
I know my high school had a rule against clothing that the administration deemed "disruptive."
But I think the best solution would be to let the kid wear his shirt, and to then hand out T-shirts that say "Daxx Dalton's Dad Is a Douche" to anyone who wants one.
Schools operate outside the realm of the first amendment, it seems. A school has the right to set its own rules about dress codes. I remember we were told to stay within certain parameters when I taught, even though they violated our Constitutional rights.
So-the school has the right to enforce its rules even though the kid "legally" can wear whatever he wants.
Schools definitely have a right to set a dress code. All businesses do, too. They have a right to refuse service to anyone, as well.
Why is that so hard to figure out? Didn't you people ever go to school, once upon a time?

The father clearly was looking for publicity. If his son was ignored and was allowed to wear the shirt another stunt would have been orchestrated. This father's venom towards liberals in my opinion is terrifying. Can you imagine the school board sitting down with this man trying to discuss the matter? The man is exploiting his child and is desperate for some attention. He will probably be offered a job as a commentator for Fox after all of this.The man is looking for his 15 minutes and he is using his son to do it. I would hope when his son gets older he see's the abuse his father put him through for his own personal gain and ends up hating the hick.

Joe, I am not as worked up as I was when I first posted this but you are right, this sort of thing anger me and scares me at the same time. Alan Comes is not my favorite liberal but I thought he was very patient with the guy. This is not new. There have been kids kicked out of school for wearing gay pride shirts and other political shirts and I have mixed feelings about them. There was a Bush shirt regarding terrorist that I felt was in bad taste. As much as I despise Bush, I found the shirt distasteful.
Time will tell how this case is viewed and maybe it won't even make the news.I just felt the shirt was racist and disgusting.

I'll agree with Disgusting- It looked like a XXL shirt that a truck stop fry cook wore through a double shift. My God, you could smell it through the computer screen. They should have made Hannity sit in the studio with them for the interview. I guarantee he'd be a LOT less supportive.
Not for nothing, romantico, but lots of conservatives feel that Obama is too lenient in his stance on terrorists. You think that shirt is disgusting, but it's symbolic of one of the biggest issues in this election. Why is it racist, because Obama is black? Do you think the conservatives would like a white man who held the same views as Obama towards terrorism?
What I find racist is they are linking him to terrorism. Not clear if it is his name being to similar to Osama Bin Laden or not or in regards to his Islamic ties. I find his race is some of it but them hinting that anyone who practices Islam is a terrorist. Its the combination I find racist. Conservatives are VERY careful to say that the "Obama is a terrorist's best friend" refers to his "Friendship" (Non-existent) with Bill Ayers who was a terrorist when Obama was 6 and now is pretty low-key Chicago politician who Obama served on a board with. This "terrorist" thing is all over the conservative blogs- the conservatives in my neck of the woods write in to the local paper about it all the time.
