Are you trying to sue the Merrily producers? Did they deny you a refund? I’m so confused about what argument you’re trying to make here.
^ It's ridiculous to say you're not owed some reasonable likelihood of an advertised, above-the-title star attending a show. Yes, things happen, but to have the u/s go on for 5/8 shows a week, and have that attendance ballpark not be a fluke, and to continue advertising that star without announcing anything about absences, is abjectly dishonest.
People travel from far and wide to see broadway shows, and so even if they do refund you, there's already a potentially massive amount of money and hassle you've put in. Even those who live around the corner have arranged their schedules around it.

Please refer to the rudimentary legal analysis I made a few pages back. There’s more nuanced and muddy issues like reliance but certainly there’s an arguable case against the production.
Count me in with the crowd that's feeling frustrated that I haven't been able to catch Lindsay in Merrily despite several attempts. I don't at all wish to castigate her for making whatever decisions she needs to lead a happy, healthy life. However, I do wish the producers were more forthcoming and transparent on whatever is happening as this seems to be a regular occurrence. If she's missing every matinee performance, then just put out that information and I'll know to buy an evening ticket. If she's only doing four shows a week, I truly don't at all care, but I would just like to be aware.

This. I have family coming to town in the spring and decided against paying the big bucks for tickets because they don't know if Lindsay will be in and would rather save the money than the heart ache
