i dont see how there can be any question that Foley is guilty of a crime.
i mean, he sponsored the legislation himself.
"In the House, Foley was one of the foremost opponents of child pornography. Foley had served as chairman of the House Caucus on Missing and Exploited Children. He introduced a bill in 2002 to outlaw websites featuring sexually suggestive images of preteen children, saying that "these websites are nothing more than a fix for pedophiles." As it was written, the bill would have prohibited commercial photography of children, and it failed due to the unmanageable burden it would have presented to the legitimate entertainment industry.[13][14] In June 2003 he wrote letters to the governor and attorney general of Florida, asking them to review the legality of a program for teenagers of a Lake Como nudist resort in Land O'Lakes, Florida.[15]
Foley's legislation to change federal sex offender laws was supported by the National Center for Missing and Exploited Children, America's Most Wanted host John Walsh, and a number of victims' rights groups. President George W. Bush signed it into law as part of the Adam Walsh Child Protection and Safety Act of 2006."
& here's the excerpt from the legislation itself...legislation that FOLEY WROTE HIMSELF...AT THE SAME TIME THAT HE WAS DOING THE VERY THING THAT HE WAS DEFINING AS ILLEGAL.
Convicted as including certain juvenile adjudications.--
The term ``convicted' or a variant thereof, used with respect
to a sex offense, includes adjudicated delinquent as a juvenile
for that offense, but only if the offender is 14 years of age or
older at the time of the offense and the offense adjudicated was
comparable to or more severe than aggravated sexual abuse (as
described in section 2241 of title 18, United States Code), or
was an attempt or conspiracy to commit such an offense.
(9) Sex offender registry.--The term ``sex offender
registry' means a registry of sex offenders, and a notification
program, maintained by a jurisdiction.
(10) Jurisdiction.--The term ``jurisdiction' means any of
the following:
(A) A State.
(B) The District of Columbia.
(C) The Commonwealth of Puerto Rico.
(D) Guam.
(E) American Samoa.
(F) The Northern Mariana Islands.
(G) The United States Virgin Islands.
(H) To the extent provided and subject to the
requirements of section 127, a federally recognized
Indian tribe.
(11) Student.--The term ``student' means an individual who
enrolls in or attends an educational institution, including
(whether public or private) a secondary school, trade or
professional school, and institution of higher education.
(12) Employee.--The term ``employee' includes an individual
who is self-employed or works for any other entity, whether
compensated or not.
(13) Resides.--The term ``resides' means, with respect to
an individual, the location of the individual's home or other
place where the individual habitually lives.
(14) Minor.--The term ``minor' means an individual who has
not attained the age of 18 years.

Stewart is my personal hero and, for his performance on the Daily Show alone, is on my top 5 celebrity list.
It is absolutely incredible that Fox continues to spin the Democrats being behind this (I'm listening to them as they play on the tv behind me at work).
There's been absolutely NO word that Democrats leaked this. It was on the desk of a ton of news outlets who sat on it. Finally, one media outlet decided to run with it. Election year politics? Maybe. It doesn't change what is happening and what did happen, though, and the FACT that Boehner and Hastert both knew what was going on.

Posted: 10/4/06 at 8:01ami believe that some of the grey area in whether or not this is a crime comes from the fact that the legislation was passed in 2006... those ims came from 2003 and i don't know when the other emails and messages came from but it seems to be from years past not this year... and yes Jon Stewart is amazing

I continue to be fascinated by how quickly this member of the "party of personal responsibility" has embraced the "victim" tactics the GOP supposedly deplores. The same people who'd fry Andrea Yeager are pulling out booze, molestation, and most odious of all, the McGreevey "I am a gay American" defense. The use of a coming out statement in this context, like McGreevey's, is really loathsome.
Have we all noticed the strategy of right wing nutjobs, like Tony Perkins of the America Family blah-blah? They are citing a "climate of tolerance" toward homosexuality as a reasons this happens. In other words, accepting gay people in our society means they'll go after your kids. And we have Dr. Drew on TV going overboard to say "no, he's not a pedophile, he just likes teen boys." This case has far darker implications for gay rights than meets the eye.
Eerily, it plays into the Anita Bryant "freshening the ranks" mindset. Stupid people everywhere will remember one thing about this: it's same sex luridness. Will someone else notice this sooner rather than later?

And yet, responsible people need to be proffering up numbers of underage offenses because I'm quite confident the same-sex versus opposite sex ratio is about what you would expect.
