California is able to issue marriage licenses to same-sex couples, as it has already issued 18,000 marriage licenses to same-sex couples and has not suffered any demonstrated harm as a result,see FF 64-66; moreover, California officials have chosen not to defend Proposition 8 in these proceedings.
Because Proposition 8 is unconstitutional under both the Due Process and Equal Protection Clauses, the court orders entry of judgment permanently enjoining its enforcement; prohibiting the official defendants from applying or enforcing Proposition 8 and directing the official defendants that all persons under their control or supervision shall not apply or enforce Proposition 8. The clerk is DIRECTED to enter judgment without bond in favor of plaintiffs and plaintiff-intervenors and against defendants and defendant-intervenors pursuant to FRCP 58."

It appears that getting a stay from the 9th Circuit Court is a little tougher than I thought. Still do-able.
The are still discussing the issue with Pat Morrison. Worth a listen to.
What are the chances of them appealing and winning? This can't keep going back and forth. This needs to stay as it is. Oh, and has anyone thought about all that Mormon money spent in 2008? IMO,that's the best part!
I got the feeling from listening to go-to law expert Erwin Chemerinsky that overturning it is indeed possible, but that it will be a lot harder if a stay is not issued.
The longer gay and lesbian people are allowed to marry, the harder it will be to overturn it.

The Court used the Due Process and Equal Protection Clauses. It is 138 pages based on testimony and facts with a correct conclusion. The Supreme Court will likely make this a state's rights case and ultimately reverse.
