SCOTUS upholds healthcare law

The decision from SCOTUS on the healthcare act should be handed down around 10AM. There will probably be confusion at first as different legal 'experts' try to figure out what it means (many 'experts' misinterpreted the Arizona immigration decision).
If the SCOTUS throws out the law, my oldest daughter will likely lose her healthcare coverage, which she gained when the law was enacted, so you can guess where I stand on the issue.

I honestly think it will be upheld.
But, BTW, I think Scalia will go off the rails. He has become an advocate, and not a jurist, and may actually be driving some of the judges to the middle. I miss Rehnquist.

If Thomas had any honor, he would have as well.
His wife gets paid by groups advocating for ACA repeal.
But, upheld. Suck on that.

Posted: 6/28/12 at 10:14amLooks like they said the mandate is not supported by commerce clause, but is viable as a tax.

Posted: 6/28/12 at 10:21amFunny, the website for Fox 'News' is usually the quickest getting info online, but they're trailing the reporting off the others. Must be figuring out how to spin this as a negative for Obama.

Spin how they like, a conservative court supported the centerpiece legislation of Obama's first term.
Hah!

My local (right-wing) paper had the headline "Court Strikes Down Obamacare" up till about 20 after 9. Now they've changed it to "court Upholds Parts of Health care law." The wingnuts are gonna need some anti-psychotic drugs ASAP

And I'm surprised Fox didn't have a spin story all ready to go...

I was thinking the same thing. Could it be that they were SO certain of the outcome that they didn't draft 'disaster' scenario spin coverage?

This is what the main page of Fox News says right now. Oops.
It's funny that they can't even refer to the bill by its proper name.

Here's a quick analysis of the vote by Ari Ezra Waldman of towleroad.com, who will have a full analysis up later this afternoon. Reading him always makes me feel smarter about these things.
so, here's what seems to have happened (though we don't have the opinion yet): 4 justices (kennedy, scalia, thomas, alito) would have invalidated the ACA in its entirety. 4 justices (ginsburg, breyer, sotomayor, kagan) would have upheld the ACA. the Chief Justice (Roberts) said no the Commerce Clause rationale, but said yes to the Taxing power rationale to uphold the law. So, that 5 votes for upholding the law as a lawful use of Congress's taxing power. And, since you only need one source of Congressional power, the Commerce Clause argument really didn't matter.

Posted: 6/28/12 at 10:44amLiving in the bible belt, Fox loving, Republican part of Florida, I am reading so many posts that are calling this a communist move and that people are preparing to go to jail because they can't afford insurance. They are saying that their rights are being taken away. This is why I love to escape on BWW! I used to be a pharmaceutical rep in a poor part of the city. I used to watch patients leave a doctor's office in tears because they couldn't afford their drugs- after I just spent $350 providing lunch for the office staff. Am I a communist because I think that was just wrong? Are these same people going to call for the SCOTUS to be fired because of this vote? Geesh!
