The Chief justice decides who writes the majority opinion- when he's in the majority. If he's in the minority, the senior justice in the majority decides. But he was the swing vote- whichever way he decided he'd be the majority.

I think Goth is parroting part of the right wing explanation for this loss- they KNOW they are right as THEY are the ONLY ONES who know what the constitution means so there HAS TO BE a reason for this loss- and it's Roberts "trading his vote" so he can write the opinion, whatever that's supposed to mean.

One of the first phone calls that House Minority Leader Nancy Pelosi (D-Calif.) made was to Vicki Kennedy, the widow of former Sen. Ted Kennedy (D-Mass.), who spent his lengthy career in public service championing universal health care, according to an aide.

Pelosi told Kennedy: "Now, Teddy can rest."

I am a bleeding heart liberal, but that brought tears to my eyes.

So the Tea Bagger message seems to be This is a TAX and OBAMA RAISED YOUR TAXES. Jindal and Palin have already started that drumbeat and some doofuses (doofi?) have started the rants that people are going to prison for not having health insurance.

And under the hash-tag #pointless, the house has scheduled a repeal vote for July 11.

So I don't watch Fox news and I'm not a right wing republican(i'm not registered to any party). I fall in the middle with my views.

I'm against this health care act and I'm not happy about it. Seems like I'm the only one on here against it.

It's not just the Tea Bagger message--that was the court's ruling. They said that the Mandate could NOT stand on the basis of the "Commerce Clause," which says that Congress can regulate interstate commerce.

The mandate could stand only because the Constitution gives Congress the right to levy taxes, so the penalty a citizen will have to pay if they fail to purchase health insurance will be considered a tax.

So the precedent it creates is that Congress can vote to levy a tax, which means that Congress can also vote to repeal a tax.

This is how the Mandate was allowed to stand, and this is how the Republicans will campaign to repeal the law. Get ready to hear a lot about taxes from now till November.

I'm in my mid 20s and pay for my own health insurance, doesn't cost all that much. My issue with this is that the rich already have insurance, the middle class is split with people who have it and people who don't.

The poor who can't afford it is where the problem lies, if they can't afford health insurance then how are they expected to pay these "fines" when they still don't get health insurance.

In the long run it's the middle class that is going to be affected yet again. I'm just rather tired of having these people tell us what to do. If I choose not to get health care, it should be my issue not the governments but when we have our mayor Bloomberg telling us what we can't drink and where people can't smoke none of it really surprises me.

It doesn't matter who is in charge, Obama, a republican, whoever. They are all the same in the end.

Bob: It's not my fault I got cancer when I was three! Besides, that was years ago!

Insurance company: If we sell insurance to you, we'll probably lose money, and we're not doing it.

Bob: But I need insurance more than anyone! My cancer might come back!

Insurance company: We don't care. We're not selling you insurance.

Obama: Hey, that's totally not fair. Bob is right, he does need insurance! Sell Bob some insurance.

Insurance company: If we have to, I guess.

Mary: This is cool. Obama said the insurance company has to sell insurance to anyone who needs it.

Sam: Hey, I have an idea. I'm going to stop paying for health insurance. If I get sick, I can always go buy some insurance then. The insurance company won't be able to say no, because Obama's told them they have to sell it to anyone who needs it!

Dave: that's a great idea! I'm not paying for health insurance either, at least not until I get sick.

Insurance company: Hey! If everyone stops paying for insurance, we'll go bankrupt!

Obama: Oh come on Sam and Dave, that's not fair either.

Obama: Oh for god's sake. Sam, Dave, you have to keep paying for health insurance, and not wait until you're
sick. You too, Mary and Bob.

Mary: But I'm broke! I can't buy insurance! I just don't have any money.

Obama: Mary, show me your piggy bank. Oh, wow, you really are broke. Ok, tell you what. You still have to buy insurance, but I'll help you pay 95% of the cost.

Insurance company: We're not paying for that aspirin.

Once the healthcare exchanges are up and running, the cost to join will be a sliding scale based on income. And the problem is multi-facted; the poor who can't afford healthcare are using more expensive emergency treatment, and many young, healthy people are opting to drop coverage.

"If I choose not to get health care, it should be my issue not the governments..."

That's a pivotal point, but the government already compels us to pay into Medicare and Social Security, so while you may disagree with the merits of the mandate, this law was not an expansion of the government's role.

"It doesn't matter who is in charge, Obama, a republican, whoever. They are all the same in the end."

If you look at the details of the law, it really is an amalgamation of liberal and conservative ideas, and the mandate was always promoted by the right, that is until it was included in the law.

But all the power is in the hands of these health insurance companies. Are the prices really going to go down in price? Nothing else ever goes down in price. I'll believe it when I see it. Look at gas prices, look at the tolls that Port Authority does to us.

I'd also opt out of Social Security if I had the choice. I don't believe my generation or the younger generations will even see it because of all the talks about the funds running out in 20 years.
