Forgive the language, but Holy MutherF*CKing SH*T.
I'm frankly stunned. But, as my boss pointed out, Roberts is "a cynical son of a bitch" who knew that striking the law down would drive the Dems to the polls. I'm not EXACTLY sure I agree with that. I think it would have devastated the Dems.

As far as Roberts was concerned, this was far more legacy than legality. He is very concerned about how his court will be remembered. Just a little surprised he couldn't pull Kennedy over to make it 6-3 rather than 5-4.
My hope is that there may now actually be some accurate information about the law my our media. The parts of the law poll VERY well when asked as questions like "Do you think insurers should be able to deny coverage because of pre-existing conditions", but when asked what they think of 'Obamacare', the polling plummets.

Posted: 6/28/12 at 10:59amConsidering that both the WH and political commentators point to the Massachusetts healthcare law as a template aka Romney's healthcare law, I really do not think this is good for the Republicans on a national level. If Obama is putting out the Bain Capital assault, imagine the possibilities with this decision.

Roberts may be cynical, but I don't think your boss is right about what would have happened.
It can just as easily be argued that seeing this as a win will reinvigorate support for Obama.
I see his point but think I agree more with you. I guess we'll see in November.

But it seems like it would take a peculiar combination of cynicism blended with an idealistic respect for the Voters to think that striking down "Obamacare" would motivate Democratic voters to vote.

He went on to say Obama had "Wasted" his term in office and passing "Obamacare" was a "Moral Failure."
To which I say "oh yeah?"

And the government compels you to do all sorts of things farther "out there" than carry insurance. And if they had struck this down, all those things would be up for review. That is not the sort of Legacy Roberts wants.

The majority opinion is written by the senior justice of the majority. If Kennedy had voted for and Roberts against, then Kennedy would have written the majority opinion.
For future cases, it's more important who writes the majority opinion because the wording in the MO will be used. Roberts could have voted in favor so that he would get to use the wording he wanted for this decision.

I think you're mistaken. If that were true, Scalia would have written every decision for the usual 5-4 split in this court, and I don't think that's been the case.
