More than likely, if the $39 rush tickets are gone, they will, as the poster above mentioned, offer you the $55 tickets which they are likely to have so I think one way or the other, you'll get in.

I went on a random saturday in June when my mother visited. We got really great mezz seats from the TKTS booth at around 6:30-7pm for $60 each, so I think you'll be fine.

I have rushed this show more than once. Right now it seems like they are offering partial view rush for $39 and full view rush for $49. I've sat in both and it's worth it to pay the extra $10 because there are some pretty bad seats in this house. Not sure if this partial view/full view is for every performance but I have had this experience twice now (on a Monday and Friday) and a friend of mine who rushed this past Tuesday was offered the same deal.
The box office has been instructed to sell the tickets in any way that they can. What that means is that if there is an empty seat 10 minutes before curtain they will sell it to you at rush price. I was at the show last week and the balcony was almost completely empty... so... there you have it.
My friend and I rushed last Saturday for 4 tickets to the evening performance. We got to the box office around 10 minutes after 10am and were about 20th in the line that was there at the time. We were offered partial view for $39 or full view for $55 (we chose partial view). When I told the box office attendant that we'd be happy with being split up as two groups of 2, sitting near or behind one another, she said that that was likely the seating arrangement we'd get anyways (which turned out to be the case). We got Orchestra L26, L28, M26, and M28, the farthest House Left you could sit in those two rows. The view was fine for what we expected, with no overhang issues and only really missing out on what was happening on far stage right (For context: About 2/3 of the Ho Chi Minh facade was cut off during the big dance sequence in Act I). After intermission, we moved in 3 seats towards the center, which was enough to pretty much see the entire stage.
If anything, I think it's better to have House Left partial view than House Right partial view because the loft where Chris and Kim, uh, interact is on Stage Left; thus, our partial view seats had full view of those scenes.
