According to E! Online, the conversation was actually recorded by Eszterhas's 15-year-old son, who was "adamant" that his dad release it. At least that's Eszterhas's story, anyways.

I am not an apologist for him, however I do respect his talent as a director, ator and businessman Sometimes I feel these "released" audios are in a sense a form of extorsion, some get even vendetta. Yes, he needs help desperately.
