Further, to PalJoey's point, Scalia actually requested that Obama nominate Justice Elena Kagan for a vacancy. His political views might have been horrendous but he was very close to many Liberals. He was from an era where people could "agree to disagree" in a civil way.
"Let me put a finer point on it," the justice said, in a lower, purposeful tone of voice, his eyes fixed on mine. "I hope he sends us Elena Kagan."
I was surprised that a member of the court would so bluntly propose a nominee, and intrigued that it was Kagan, the former Harvard Law School dean who was appointed solicitor general by Obama to represent the government before the Supreme Court. Though she had worked on policy in the Clinton administration and had a reputation for pragmatism, Kagan plainly would be a liberal in the context of the court.

Scalia could agree to disagree in a civil way with people of similar standing.
That said, he did not agree to disagree in a civil way from the bench, where it mattered to the masses.
He have been a a principled man in certain areas, in his ideology, but he was not a principled man in his application of the law.
Scalia was a bigot. Scalia was ignorant. He may have had a brilliant mind for writing rulings, he may have been the unexpected hero of the marriage equality movement, but he was the epitome of what a SCOTUS Justice should NOT be - fiercely partisan in behavior and loved to play politics, openly touting how he knew how he would rule on a case before arguments were made regardless of what is presented,
The man is dead. The world is a brighter place. I hope it was a slow, lingering and scary death. The man doesn't deserve mercy or pity. His actions as a consequential public figure do not earn sadness from sane people.
(and while they are obviously vastly different, even Hitler had friends who were sad to see him die... So did Bin Laden. So?)

And then turn around and legislate in a way that hurt real people living real lives. But thank goodness for civility?
"agree to disagree"
Is this not rich, coming from the person who has said that people who don't vote the way he instructs (even though he doesn't vote) are "wastes of human life," "PsOS,' and other such genteel terms of endearment?

If Obama does indeed send up a nominee to replace Scalia, shouldn't candidate Ted Cruz recuse himself from the proceedings seeing that he sits on the Senate Judiciary Committee?

Obama should nominate Tino Cuellar (link below). Blocking a Hispanic nominee will play really well in the general election.

Nobody proposed that we kill him or even hurt him when he was still alive.
Not in writing, anyhow.

Madbrian, I thought his name sounded familiar. He's extremely accomplished but please check out his wife's bio. I'd like nothing more than to have a Supreme Justice like her who not only understands the intricacies of IP law, but also has keen insight into the business practices of Silicon Valley. Talk about a power couple in judicial circles.

Once upon a time in America, I guess, we routinely agreed to disagree. Ruth Bader Ginsburg is a class act, and if she tells me Justice Antonin Scalia was an honorable man, well maybe he was.
But she and I can still agree to disagree.
" such a great way to think Pal Joey. If we keep antagonize people we do not agree with, they will not want to compromise. When they do not want to compromise, we will not want to either. That is cause of the mess.

There is no thinking homosexual person who is aware of the court in the US who did not feel antagonized by Scalia.

I understand what you said. But I am not saying you cannot disagree or not like or even despise someone based on his views. Of course you will and there is nothing wrong there. I just think when someone has died and people are mourning a respected person, a little respect goes a long way. Just put shoe on other foot if it was someone you respected, but was controversial Ruth Ginsburg? Jimmy Carter? in some of his decisions or his statements. You would naturally be angry at others for the disrespect. Which as I tried to say, would make you angry, or not wanting to compromise or find a middle ground.

When this particular dead person was alive he didn't respect people whose lives his decisions had profound negative impacts on. So, nope. No propriety. No faux-civility. He earned none of that.
Jimmy Carter used to be your old screen name's bete noir too, Petrastorm.

Please find me a statement that RBG made that was nearly as vile as some of Scalia's about homosexuality. Or a statement from RBG stating that African-Americans should attend lower level colleges because they just aren't intelligent enough to hack it at a top school. I'd love to see those statements.

I hope Obama does not get a chance to nominate someone new...he messed up this country enough as it is, including with race relations, and especially foreign policy!

Yes, it's not the racists who are the problem.
But of course he will nominate someone. It's his job.

It was also his job to take out ISIS 2 years ago, and to negotiate a decent deal with Iran, also to help Israel against the daily terrorism they face. But, he failed at those, all got with his agenda.
