"SAN FRANCISCO (AP) - California's highest court agreed Wednesday to hear several legal challenges to the state's new ban on same-sex marriage but refused to allow gay couples to resume marrying before it rules.

The California Supreme Court accepted three lawsuits seeking to nullify Proposition 8, a voter-approved constitutional amendment that overruled the court's decision in May that legalized gay marriage.

All three cases claim the measure abridges the civil rights of a vulnerable minority group. They argue that voters alone did not have the authority to enact such a significant constitutional change.

As is its custom when it takes up cases, the court did not elaborate on its decision.

Along with the gay rights groups and local governments petitioning to overturn the ban, the measure's sponsors and Attorney General Jerry Brown had urged the Supreme Court to consider whether Proposition 8 passes legal muster.

The court directed Brown and lawyers for the Yes on 8 campaign to submit their arguments for why the ballot initiative should not be nullified by Dec. 19. It said lawyers for the plaintiffs, who include same-sex couples who did not wed before the election, must respond before Jan. 5. Oral arguments could be scheduled as early as March, according to court spokeswoman Lynn Holton."

They will also rule on the status of marriages that have already taken place, "Those marriages have been seen as being in legal limbo" See, they're still trying to make limbo happen.

It's good to see this happen because the Supreme Court is not going to let discrimination stand.

If they do uphold the change, I guarantee you that there will be riots in the streets, and I'll be the one in front.


I have spent all day on the phone with the people at Double Tree in OC and with their corporate offices (Hilton) and feel like I may have gotten them to get something about that hateful, lie-filled, YouTube video.

I urge you all to take a moment and send them an email or call them to let them know that they should have the video removed, or at least ask to have their hotels logo blocked.

Telling me, "Well, you can come and rent the podium, and shoot a video behind it, if you wanted to", is NOT an answer.

Wow I saw your reply to the inquiry about the hostile video posted on YouTube clearly showing the Doubletree logo from Santa Ana. Your reply that anyone can rent the podium and make their own video showing your logo is possibly the worst reply I can imagine.

As a long time user of Doubletree hotels for business travel I am stunned, and will cease using Doubleltree hotels for future travel.

But of course it goes beyond this: Imagine if the KKK used your hotel and taped a video against people of color. Or if a Christian group made a video that spoke out against Jewish people. I can guarantee you that the hotel would not only request the video be removed but would also start legal action.

Your very act of indifference to this video sets the tone for how you see this issue. You don't see significant link between your hotel and a hostile group speaking out against the rights of a minority.

But when Doubletree gets added to the list of businesses and individuals, who want the gay dollar but don’t respect their rights, this will begin to make a very significant impact.

I am going to take your response to a higher level in your organization to ensure that your comments are made known to your employers.

I request again that you not only look at this video but take corrective action and tell YouTube to remove it. You have a very legitimate reason to request this. The video clearly shows the Doubletree logo which would indicate the unauthorized endorsement of the Doubletree Hotel for Prop 8

I don't get it... they lost. Live with it! The people spoke, and they said they wanted traditional marriage. Let it go. Why must we change tradition because a few people are PO'd that they can't get married. Before people start calling me a homophobe, I am gay myself. Why can't we just keep marriage the way it is. Gays will always have those civil unions. Live with that!

Umm... wow. You are a disgraceful person. Because I am gay, i must instantly be for gay marriage? First of all, Log Cabin is for gay marriage. Second, I dislike that group. What is bigoted about opposing same-sex marriage? Nothing. These people aren't anti-gay. They just view marriage the way it was always intended. A religious institution between two members of the opposing sex meant to procreate. And why can't you have a civil discussion without calling me names and saying I should kill myself? No wonder the gay rights movement failed even in California... people like you could turn anyone homophobic.

Civil rights should NEVER be left to popular vote. It legitimizes the majority oppressing any minority. In 1961, when President Obama was born, his parents would not have been allowed to marry in seventeen states. This issue will ultimately be resolved in the courts, eventually in the SCOTUS.

Roninjoey: Why are people on this thread so convinced I hate myself? I most certainly do not. Just because I have an opposing view that would restrict my right to marry I must hate myself? I am absolutely offended at that blatant calumny. And what did I mess up with my analysis of marriage historically? Because I know enough evangelicals to say thats what they believe to be true, and isn't that what should matter since they are the ones who oppose marriage. Also, you play me off like a religious nut... I most certainly am not religious.

madbrian: I am not saying it should be left up to a popular vote, but is there really any other way to do it? And what would be wrong with keeping traditional marriage, and instead gays staying with civil unions with fairer benefits.

I know. I blatantly believe that eventually gay marriage will be legal in every last state. Looking at the generation of teenagers being far more accepting of it, eventually it will start to sweep the nation. Why can't gays just leave it at civil unions with benefits. Why must gay's get the word marriage?
