Mr Barbour's own words used against him. I've read this over and over on this thread.
Mr. Barbour's words were apparently on a tape LEAKED BY EITHER THE PROSCECUTION OR THE WOMAN'S LAWYERS to the press. And we've spentHUNDREDS of posts discussing something that may be taken out of context (I assume the prosecutor would not release exculpatory evidence) or may be shaped and described in a way most favorable to the woman. Why? TO INFLUENCE A POTENTIAL POOL OF JURIORS.
How many times do I have to tell you people that all of this should be taken with a grain of salt. Those "words of Mr. Barbours" may never see the light of day in a court if they were illegally tapesd by a person who is not a law-enforcement officer. His lawyer will plead that his right against self-incrimination was abrogated. There are a dozen ways to get the tape ruled inadmissable.
Then it's his word against hers.
BUT if you leak the tape, it serves the same purpose because it pollutes the jury pool.
I am not in any way saying that the accused is innocent or statutory rape isn't a terrible offense.
I'm just saying that there is a lot of gamesmanship being exhibited here and we are playing right into the hands of the people who leaked this tape.
For the victims whose statute of limitations has run out; the prosecutor will not allow them to testify at sentencing (if it gets to that point) unless they are credible.

Marlo, what qualifies someone as credible in a case like this? Obviously it's too late for her to press any charges, but who determines whether she is credible enough to testify?

Well I think everyone can expect she's going to get badgered in court, and be so confused and embarrassed she might just break down right there. And then everyone will sympathize.
"In a written statement signed April 4, 2006, and made public Wednesday by Rosenthal, Barbour said sexual contact with the girl, a student at his alma mater, was initiated by her when he had dinner with her and her boyfriend.
"At that dinner, I was sitting next to her and our knees touched," the statement said. "Her hand was on my knee and rubbed up against my (illegible)."
The girl later told him she was 16 and wanted to pursue a career in theater, Barbour's statement said. He said he offered to help and stayed in contact with her through e-mail, the statement said.
During a subsequent telephone conversation, the statement said, Barbour asked the girl what she was thinking the night they had dinner together, "and she said 'I was thinking I wanted to"' have sex with him.
One evening before Barbour's performance in "Jane Eyre," he and the girl went to his Upper West Side apartment, the statement said.
"We were laying (sic) on the bed and she spoke about losing her virginity to (her boyfriend)" and discussed sex acts, Barbour's statement said. "We did kiss, and then she originated again about sexual intercourse."
"At that time I sort of freaked out, said she was 16, and that I couldn't do this," the statement said. "The relationship stopped suddenly because I thought it was inappropriate and could get dangerous."
Rosenthal also said there were tapes of Barbour speaking by telephone with the alleged 15-year-old victim about the case. "He himself refers to it as unethical," said Rosenthal, who provided the defense with a copy of the conversation tapes. "
Leaks? Seems like just normal disclosure to me. Also as per the legality of the tapes-Correct me if I am wrong but recordings are asmissible as long as one of the parties being recorded are aware of the recording taking place.

A good lawyer can get a smoking gun in the hands of the defendant standing over the body of a victim ruled inadmissable. Honestly, don't you ever watch "Law and Order"?
Obviously, his lawyer has some defense plan. Why else would he talk about "signed statements?"
This is getting very interesting. Let's let this die off now and watch what happens in the press. Speculation just plays into the lawyers'/prosecutors' hands.
(The interesting things is the lawyer admits about the statement in which Mr. Barbour clearly shows he realizes sex would be wrong. And therefore didn't do it. It might be a "I admit I was there and could have, but didn't" defense which is risky but very clever and... YOU SEE I'M STARTING TO DO THIS AGAIN TOO!!!!!! DAMN!!!!!)

oh god, can u imagine? I'll often walk past the building on my way to the city hall area, and there will sometimes be protestors or press if it's a high-profile case like with Martha Stewart or when Boy George served his community service down here.

I just think it is funny that this is constantly labeled a "sex" scandal. We definitely have a kiss admitted to on both sides, and possibly oral. Ummm, that doesn't seem like a "Sex" scandal to me. Before I get jumped on...I am not saying I think that a kiss/oral is ok with an underage person. Any contact with an underage person is illegal, plain and simple.
