Can you clarify why you're using the term 'hate speech' here? I didn't see the term used in the article and I haven't seen court papers, so I don't know if it's used there (thought I would bet it isn't). Was it used somewhere else that I didn't see?
Hate speech is still legally protected speech in the US, so I can't imagine any lawyer would use that term in any such lawsuit. However, if what is presented in this article is true, it's a clear case of sexual harassment and bullying.
"hate speech" has nothing to do with this. It is a term used as an enhancement to criminal conduct. No one is alleging criminal conduct here. And in an employment context, which is what this is, what she said is certainly relevant to the claims that are reported to have been made.

That's what I'm saying. The offending quote from Dunaway was in the headlines of multiple articles, which seems odd since this seems like a wrongful termination lawsuit, not a lawsuit for Dunaway just being a b*tch.
