I have tickets for tomorrow (Sunday evening) and just noticed that both Marla and Constantine are going to be out, which isn’t great in the week leading up to the Tonys. Since I am returning to the show mainly to see them, I tried for a refund, which they wouldn’t offer because the performers are not above the title. Seems like there should be an exception for Tony-nominated leads, but no. And yes, they did offer an exchange for another date, but I don’t have any availability on my planned trips. And trying to sell my tickets to this show without the nominated leads would probably be a big loss. Very disappointing.

Could you try past-dating them on your next visit? It’s been years since I’ve done it so I could be forgetting stipulations - but it’s possible that something in your schedule could open up again.

Thanks. They did give me info on past-dating, but the language seems very noncommittal on availability, and I’m not sure if I’ll be back before it closes. Which seems like it might be before its scheduled closing in September. I’ll just suck it up with the understudies, who I’m sure will be fine (just not Tony nominees).

Coming late to this conversation, I saw the basement production, and Deitch's performance was wonderful. The surprise of the character she created absolutely killing "All By Myself" was one of the unexpected joys of the show. The Broadway star casting now carries an expectation that the role will deliver a show-stopper,
That said, I found some of her arguments—and at times the podcast host's somewhat snarky agreement with them—confusing. If I'm understanding the situation correctly, Deitch made significant creative contributions to the show and was informed at each stage what the next step would require. She knew she would need to relocate from California to New York and secure housing as the production evolved. As each phase led to another, requiring more time and investment in New York before ultimately reaching the basement production, her frustration appears to have grown.
My impression is that she expected the show to compensate her for that investment and contribution beyond the terms of her contract. If I'm mistaken, someone can correct me, but it seems that this expectation contributed to her decision not to continue to the production at the Daryl Roth. When discussion turned to an original cast recording, she expected to be included, but the producers intended to use the Union Square cast instead.
Now that the show has transferred to Broadway, she appears to be seeking the contractual payout associated with not moving forward with a production. I don't recall the exact number of weeks involved, but my understanding is that the producers have disputed that obligation, which is why the matter is headed toward arbitration.
What remains unclear to me is whose claim would prevail if such a payout exists: would it belong to the basement cast or the Daryl Roth cast? Either way, Deitch ultimately chose not to continue with the show, whether for personal, financial, or professional reasons.
Beyond that, much of the current discussion feels like noise until the arbitration process produces an actual decision. At this point, we only have one side of the story, and without knowing the producers' position or the specific contractual language at issue, it seems premature to draw firm conclusions.

Deitch doesn’t have a (legal) leg to stand on. Once she turned down the next “step” of the production, she waived all future rights for any subsequent productions. There’s a reason no lawyer will take her case, and now she’s just trying to make enough “noise” that they’ll pay her to go away.

It’s possible, maybe even likely, she was taken advantage of in that early iteration of the show and had she been aware of her rights and contractual terms, she may have gotten something out of it. But it seems like that window has long since shut and her negligence, in either employing poor representation or not doing due diligence in regards to what she was agreeing to, is the cause. Gloating on social media about the drama she’s allegedly stirring up and the money people have sent her also certainly isn’t a great look for her credibility. Regardless, it seems like this is a tempest in a teapot that isn’t affecting much of anything.

Did anyone watch her appearance on StageLeft? It seems it was only up for 72hours.
I suspect the only thing Kathy Deitch will get from this is the tips she bragged about and the certainty that no one wi the any sense in this business will want to work with her ever again.

Yeah, her StageLeft interview is now only available through the paid Substack.
I’ve seen her respond to comments (multiple times) telling her that she’s going about this the wrong way, and her reply is “well my engagement is still going!” - as if said engagement is going to help her with future employment?
